Texas Prenuptial Agreements
Frequently at least one of two persons going to get married have acquired substantial assets prior to the marriage. A pre-nuptial agreement is recommended in these cases to deal with the preservation of the pre-marital estate in the event of subsequent divorce.
Once married, it is difficult to address these issues. It is best to deal with them while the marriage is somewhat in the future. Doing so on the eve of marriage can undermine the validity of such an agreement.
These agreements can be tricky to draft so that they will stand up later on. Michael Wald can handle these issues for you. Remember, an attorney can only represent one of the spouses. To make the agreement more bullet proof, it is recommended that both spouses have independent attorneys. Full disclosure needs to be made to or waived by the other spouse.
Pre-marital agreements can also be used to modify the rules of community property to re-define how YOU want to treat your property acquired or salary earned after marriage.
If you are interested in preserving your pre-marital estate or redefining who will own what after marriage, call Mr. Wald today.
